Terms & Conditions
Clean Energy Allies are contractors, architects, engineers, equipment vendors, distributors, manufacturers and retailers who provide energy-efficient products and services to residential and business electric ratepayers of Hawai‘i, Honolulu and Maui counties. They help us extend our reach by delivering energy-saving incentives, education and other Program benefits directly to electric customers.
To become a Clean Energy Ally, you must meet and perform in accordance with the following requirements and agree to adhere to the Clean Energy Ally Code of Conduct.
- Hawai‘i Energy wants to provide all of our customers with excellent customer service. As our market multipliers, knowledge and understanding of Hawai‘i Energy rules and technical requirements is the responsibility of the Ally. Allies may reach out to Desiree Sumaoang at Desiree.Sumaoang@leidos.com for program assistance/questions at any time. Hawai‘i Energy’s expectations of our Clean Energy Allies are as follows:
- Conduct business with customers and the Program with honesty and integrity.
- Read, sign and agree to follow the Clean Energy Ally Code of Conduct.
- Maintain current and necessary vendor compliance to do business in the State of Hawai‘i. Upon request, be able to provide Hawai‘i Energy documentation of current and necessary vendor compliance.
- Maintain necessary certifications and the customary and legally required insurance coverages for appropriate business type. Upon request, be able to supply evidence of current insurance.
- Clean Energy Allies, and any subcontractors, must maintain and, upon request, produce appropriate licenses and certifications for the work they are performing.
- Be able to provide a valid W-9 upon request.
- Read and understand emails and other information provided by Hawai‘i Energy.
- Adhere to Hawai‘i Energy Program guidelines and contact us when you have questions or don’t understand something about the program.
- Maintain current and accurate company information in the Hawai‘i Energy Clean Energy Ally web portal and other systems made available to you for this purpose. Clean Energy Allies are wholly responsible for the accuracy of their corporate information provided to the Program.
- Participate in at least one (1) project per calendar year or may be subject to removal as a registered Clean Energy Ally of Hawai‘i Energy.
- The Clean Energy Ally agrees to abide by all applicable laws, regulations, building codes and licensing. Your firm must be in good standing (i.e., no outstanding, unresolved complaints) with Hawai‘i Energy and other applicable agencies as determined by the Program.
- The designation of Clean Energy Ally and being listed in the online ally directory does not constitute an endorsement of the Clean Energy Ally by Hawai‘i Energy.
- Clean Energy Allies agree to receive email communications from Hawai‘i Energy.
- Hawai‘i Energy reserves the right to modify incentive offerings, program requirements and program rules on our website at any time.
- Use of the Hawai‘i Energy name or logo must conform to Hawai‘i Energy’s co-branding guidelines. Once registration is complete and the company has been approved as a Clean Energy Ally, you may download the branding guidelines and logo files from the Clean Energy Ally landing page.
- Participation in the Hawai‘i Energy Clean Energy Ally program is voluntary and may be terminated by either party at any time, with or without cause and without penalty.
- Failure to comply with the Clean Energy Ally Code of Conduct or Clean Energy Ally Application Terms and Conditions is subject to review and may lead to dismissal of the Clean Energy Ally from the program.
- It is at the discretion of Hawai‘i Energy to increase inspection rates or modify frequency of other Quality Assurance activities based on the non-compliance issue.
- Indemnification: Clean Energy Ally will indemnify, and hold harmless Hawai‘i Energy and its administrator Leidos, Inc., the State of Hawaii and its directors, officers, employees, contractors and agents (collectively, “Indemnified Parties”) from and against claims of any kind or legal suits arising out of or related to the Clean Energy Ally’s participation in this program, unless the claims or suits are caused solely by the action or inaction of the Indemnified Parties.

Ramifications for Non-Compliance with Clean Energy Ally Terms and Conditions and Code of Conduct:
- Hawai‘i Energy will maintain a log of customer complaints, issues, and other examples of non-compliance by Clean Energy Allies. Hawai‘i Energy, in its sole discretion, may suspend or revoke Clean Energy Allies participation in any Hawai‘i Energy program for violation of the program guidelines, program requirements and Clean Energy Ally terms and conditions and code of conduct.
- The terminations shall be for a 1 year period (from the date of notification) unless otherwise specified.
- In extreme or egregious cases, Hawai‘i Energy reserves the right to permanently terminate the Clean Energy Ally's participation in any Hawai‘i Energy program.
Clean Energy Ally Code of Conduct
The intent of the Code of Conduct is to outline the expectations and guidelines to participate as a registered Clean Energy Ally in the Hawai‘i Energy Program. In exchange for permission to participate in Hawai‘i Energy’s Programs, Clean Energy Allies agree to the following conditions:
Appropriately represent Role/Relationship with Hawai‘i Energy:
The Clean Energy Ally shall represent Hawai‘i Energy in a manner that does not adversely affect Hawai‘i Energy’s business, operations, reputation, or goodwill. This includes but is not limited to:
- Misrepresenting oneself or one’s company as being an employee of, representative of, or otherwise “approved” by Hawai‘i Energy.
- Truthfulness in all aspects of engagement with Hawai‘i Energy. This includes accuracy on the completion and customer eligibility of submitted applications and reports, as well as the attributed savings resulting from retrofits and the installation of approved equipment.
- Misrepresentation of project work will not be tolerated. This includes, but is not limited to:
- Falsifying invoices/applications, including, but not limited to, invoice dates, equipment costs, make and model, quantities, installation address and date.
- Forging of customer signatures.
- Applying for incentives on equipment which is not operational.
- Providing inaccurate information regarding existing or proposed equipment.
- Providing insufficient incentive credit to a customer when receiving the full incentive on the customer’s behalf.
- Conform to the Hawai‘i Energy Clean Energy Ally Co-Branding Guidelines when using the Hawai‘i Energy Logo.
Appropriately represent Hawai’i Energy Programs:
The Clean Energy Ally shall represent Hawai‘i Energy’s energy efficiency programs in an honest and ethical manner. The Clean Energy Ally shall not guarantee savings and/or rebate amounts to the customer.
Conduct business in an honest, ethical, and safe manner:
The Clean Energy Ally agrees to conduct business in an honest, ethical, and safe manner as follows:
- Comply with applicable laws, ordinances, regulations, codes and all Hawai‘i Energy Program specific requirements.
- Fulfill all contractual obligations.
- Respectful treatment of the customer’s facility and property, including communication with the customer and Hawai‘i Energy when damage to the facility or property has occurred as a result of a Clean Energy Ally project implementation.
- Not misrepresenting the benefits, financial or otherwise, of a product or service the Clean Energy Ally offers.
- Comply with the COVID-19 guidance provided by the Center for Disease Control and Prevention’s guidance for Businesses and Workplaces (https://www.cdc.gov/coronavirus/2019-ncov/community/organizations/businesses-employers.html)
Provide quality work and customer service:
The Clean Energy Ally shall not provide poor quality of work and customer service that results in numerous customer complaints, including but not limited to: installation not complete to scope, unsafe or potentially hazardous installation, non-functioning equipment, unresponsiveness to customer inquiries, and/or unresolved customer complaints.
